Delhi High Court rejects supplication to evacuate Arvind Kejriwal as CM

New Delhi, Jan 8 The Delhi High Court on Tuesday rejected a supplication looking for removal of AAP leader Arvind Kejriwal as chief minister of the national capital as he was facing prosecution in a criminal case.

A bench of Chief Justice Rajendra Menon and Justice V K Rao said prosecution was still pending in the case and elected authorities cannot be removed like this.

"Prosecution is still going on. He may get cleared. What will you do then? Come after he is convicted," the bench said.

"Nothing doing, dismissed," it said.

The court was hearing an appeal to by Harinath Ram, a promoter, looking for course to the Lieutenant Governor for quick expulsion of Kejriwal and different clergymen named as charged in a criminal case identifying with ambush of the then Delhi Chief Secretary Anshu Prakash.

The petition, filed through advocates Shashak Deo Sudhi, Bijender P Kumar and Shashi Bhushan, asserted that Kejriwal submitted break of oath under the Constitution as he was allegedly involved in acts of violence in conspiracy with other elected members.

It is an unbelievable sacred emergency that the equivalent indicting apparatus is dealing with the criminal procedures of the main priest which is lawfully under the bureau of home of legislature of NCT of Delhi, it affirmed.

The petition said people of the state have a right to be governed under the law by a honest subject and the those who enjoy criminal acts have no lawful or protected appropriate to continue as the chief minister.
