Supreme Court issues notice to Centre, asks to find replacement for death sentence

New Delhi, Oct. 6 The Supreme Court on Friday issued notice to the central government in connection with a plea seeking replacement of death sentence.

The top court has asked the Centre give a definite answer on the same inside three months.

A bench of three judges headed by Chief Justice of India Dipak Misra, while hearing the request documented by Advocate Rishi Malhotra, said the Indian Constitution is a sympathetic one which recognises principle of sanctity of life.

It observed that with the development of various modes of execution in modern time, legislature can consider other mode for death convicts, keeping in see the dynamic advance in science.

The applicant in his plea stated the execution as mulled over under Section 354(5) of CrPC (hung by the neck till the individual is dead) isn't just uncouth and coldblooded yet it is likewise against the resolutions embraced by the United Nations Economic and Social Council (ECOSOC) which has elucidated that 'where the death penalty happens it ought be carried out so as to inflict minimum suffering.''
