New Delhi, Oct 23 Central Bureau of Investigation (CBI) special director Rakesh Asthana has argued before the Delhi High Court that any examination against him without proper permission will be illegal. Showing up for Asthana under the steady gaze of the court, senior supporter Amarendra Sharan told the court that it was a case of illegal registration of FIR against the CBI special director.
"This is a case of illegal registration of FIR against CBI Special Director based on a statement of a charged. The person whose capture was recommended by Asthana has now been made a complainant and based of his complaint, the FIR has been filed," Asthana's attorney told the court.
The issue has been posted by the court for Monday, October 29, when CBI chief Alok Verma needs to react to the charges leveled by Rakesh Asthana . The Delhi High Court said that no move could be made against him till the next hearing.
The Delhi High Court further said that every electronic record, including cell phones and laptops, of the accused need to be preserved.
According to Bar and Bench, Sharan submitted under the steady gaze of the court that the arrangements of law recommend that it is important to look for consent before starting a request against a serving officer, including that "the issue is of great urgency”.
Prior on Tuesday, Asthana moved the Delhi High Court against the hotel of FIR against him in a supposed gift case.
With the war inside CBI out in the open, Prime Minister Narendra Modi ventured in on Monday, bringing the two authorities, Rakesh Asthana and Alok Verma, to the PMO. The officers were supposedly requested to offer some kind of reparation as the reputation of the organization was hit because of the feud.
On Monday, the CBI also arrested its Deputy Superintendent of Police Devender Kumar subsequent to leading assaults at his office and habitation. Kumar, who was prior the investigation officer for a situation including meat exporter Moin Qureshi, was captured on a charge of "distortion of records".
The agency registered a FIR against Asthana and a few others for allegedly accepting rewards to settle a case of meat exporter Moin Qureshi, who is facing various instances of illegal tax avoidance and debasement. The CBI has asserted that influences were given somewhere around five times between December, 2017 and October this year.
