Goa Speaker rejects Congress notice for his removal from the post

Panaji, Oct 3 Speaker of Goa Legislative Assembly Pramod Sawant Wednesday rejected a notice moved last month by the Congress looking for his removal from the post, saying it is "not maintainable".

In his request, the speaker said such a notice must be issued either when House is brought or a session is in activity.

The Congress MLAs had not specified any reason for removal of the Speaker in their notice proceeded onward September 21.

Opposition leader Chandrakant Kavlekar had stated, "We can't talk about the reason for pulling out the present moment. When it comes up for exchange on the floor before voting, we will unveil our grounds".

The notice was moved at once Chief Minister Manohar Parrikar is missing from office for a significant lot of time because of ill health.

He is currently undergoing treatment for a pancreatic ailment at the AIIMS in Delhi.

The Congress had before requested a story test asserting that there is no coordination among the coalition accomplices of the state government, and that the administration has endured.

The notice was issued under Rule 243 of Rules and Procedures and Conduct of Business of the Legislative Assembly of Goa, read with Article 179C of the Constitution .

Manage 243 states arrangements for moving a goals to request consent of the House to talk about indictment of the Speaker.

"Perusal of the Rules of Procedure and Conduct of Business and Constitution of India, as well as the perusal of the opinion of State Advocate General, it turns out to be sufficiently evident that such a notice for expulsion of Speaker, moved when neither the House has been called by the Governor nor a session is in task, can't be viewed as," the speaker said in a request issued to the Secretary, Legislature.

Leader of Opposition may be appropriately informed that the said see has been dismissed on the grounds of non-maintainability, reads the order.

Sawant had looked for the supposition of Goa Advocate General (AG) Dattaprasad Lawande on the issue.

"No summons has been issued till date, and according to my data, as on date too, the House has not been brought. Consequently, the notice being referred to can't be continued with starting at now," the AG had said.

In 40-member House, Congress has 16 MLAs, BJP 14, Goa Forward Party and Maharashtrawadi Gomantak Party (3 every), Independents (3) and NCP 1.
