Delhi High Court notice to govt on supplication for help to handicapped boy दिल्ली उच्च न्यायालय ने विकलांग बच्चों की सहायता के लिए सरकार को नोटिस भेजा है

नई दिल्ली, 30 अगस्त दिल्ली उच्च न्यायालय ने केंद्र सरकार और दिल्ली सरकार से अपील करने वाले 15 वर्षीय विकलांग बच्चों लिए आर्थिक सहायता देने की याचिका पर अनुरोध किया है।

कार्यवाहक मुख्य न्यायाधीश गीता मित्तल और सी हरि शंकर की पीठ ने दिल्ली सरकार, सामाजिक न्याय और अधिकारिता मंत्रालय और महिला एवं बाल विकास मंत्रालय के तीन सप्ताह के भीतर अपना उत्तर दायर करने के लिए कहा है, जो एक विकलांग के लिए 13 लाख रुपये मांगे हैं। एक सहायता प्राप्त स्कूल के एक कक्षा 10 छात्र के लिए यहां।

अदालत ने मामले को 26 सितंबर को सुनवाई के लिए कहा है।

वकील अशोक अग्रवाल के माध्यम से एक गैर सरकारी संगठन सामाजिक न्यायविधि द्वारा दायर याचिका में कहा गया है कि विकलांग व्यक्तियों के अधिकार अधिनियम, 2016 को सरकारों को 18 साल की उम्र तक मुफ्त में बेंचमार्क विकलांग बच्चों के साथ सहायक उपकरण प्रदान करने का आदेश दिया गया है।

याचिका में कहा गया कि वह लड़का द्विपक्षीय कोहनी से जुड़ा हुआ था (जन्मजात कमी) और उसके दोनों हाथ उसके जन्म के बाद से विचलित हो गए हैं।

दलील ने दावा किया कि बच्चे के माता-पिता विकलांग बच्चों के लिए 13 लाख रुपये का भुगतान नहीं कर सकते।

"यह प्रस्तुत किया गया है कि विकलांग व्यक्तियों के अधिनियम, 2016 के धारा 17 (जी) में स्पष्ट रूप से यह प्रावधान है कि उपयुक्त सरकार और स्थानीय प्राधिकरण विद्यार्थियों को उचित सहायक उपकरण उपलब्ध कराने के लिए बेंच मार्क अपंग नि: शुल्क," यह कहा।

"राज्य ने कहा है कि अधिकार की रक्षा करने और सभी साधनों और सामग्रियों को अधिकार देने के लिए बाध्य है।

कृष्णात्मक अंग और मशीन जिसे मास्टर रितिक से जुड़ा होना जरूरी है उनकी शिक्षा के लिए आवश्यक है और यह एक सहायक उपकरण है जो उनकी शिक्षा को आगे बढ़ाने में मदद करेगा। "



New Delhi, Aug 30 The Delhi High Court today looked for the reaction of the Center and the Delhi government on a supplication looking for money related help for a prosthetic appendage to a 15-year-old boy with handicaps.

A bench of Acting Chief Justice Gita Mittal and C Hari Shankar asked the Delhi government, the union ministries of Social Justice and Empowerment and that of Women and Child Development to file their reply inside three weeks on the request looking for Rs 13 lakh for a prosthetic appendage to a class 10 student of a helped school here.

The court posted the issue for hearing on September 26.

The supplication, recorded by a NGO Social Jurist through advocate Ashok Agarwal, said the Rights of Persons with Disabilities Act, 2016 commands the administrations to give assistive devices to students with benchmark handicaps free of cost upto the age of 18 years.

The petition said the boy was suffering for Bilateral Elbow disarticulation (Congenital Deficiency)and the two his hands are disarticulated since his his birth.

The request guaranteed that the guardians of the tyke can't bear to pay Rs 13 lakh for the prosthetic appendage.

"It is presented that segment 17(g) of the Rights of Persons with Disabilities Act, 2016 obviously gives that the fitting government and the neighborhood specialists should take quantify for giving proper assistive devices to the student with bench mark handicaps free of cost," it said.

"The state is bound ensure the said right and to give every one of the methods and materials to accomplish the said right.

The prosthetic appendage and machine required to be joined to Master Ritik are basic for his training and same is an assistive gadget which will help him in advancing his education," the supplication included.
