New Delhi, Apr 13 The Supreme Court on Friday decided to examine plea trying to regulate Chief Justice of India's (CJI) discretionary power to constitute benches and allocate important cases.
The petition to filed by senior apex court lawyer Shanti Bhushan.
A week ago, Bhushan moved toward the best court to manage the energy of CJI Dipak Misra.
In his petition, Bhushan looked for a keep an eye on the forces of the CJI, who is the 'ace of the program' and allots knowing about cases to different courts.
"The petition raises an exceptionally essential issue setting off to the base of the working of the Supreme Court of India and thusly is extremely basic to the elucidation of the Constitution of India and the Rule of Law in India," expressed Bhushan in his petition.
"The CJI couldn't have heard this case himself very separated from practicing his energy as ace of program in assigning a seat to hear this case and constituting a Constitution Bench that at long last articulated the request proclaiming the Chief Justice of India as ace of list. The standard of ace of program can't be pertinent to a situation where the CJI is himself included," Bhushan included.
On January 12, four Supreme Court judges-Justices Jasti Chelameswar, Ranjan Gogoi, M.B. Lokur and Kurien Joseph in a question and answer session, asserted that CJI Misra was assigning important cases in an arbitrary way to junior judges, disregarding them, who are the senior judges of the apex court.
On March 27, the opposition camp proposed a plan to draft an arraignment movement against the CJI in relation to the issues raised by the four judges.
