नई दिल्ली, 1 सितंबर सुप्रीम कोर्ट ने आज कहा कि वह नवंबर के पहले सप्ताह में मनी बिल के रूप में आधार कानून में संशोधन करने के लिए लोकसभा अध्यक्ष के फैसले को चुनौती देने के लिए कांग्रेस नेता जयराम रमेश की याचिका को सुनेंगे।

मामला मुख्य न्यायाधीश दीपक मिश्रा की अध्यक्षता में एक वरिष्ठ अधिवक्ता कपिल सिब्बल की अध्यक्षता वाली पीठ के समक्ष सामने आया था, जो रमेश का प्रतिनिधित्व करते थे और याचिका पर शीघ्र सुनवाई की मांग कर रहे थे।

न्यायमूर्ति ए। एम। खानविलकर और डी वाई चंद्रचुद की पीठ ने कहा कि मामला नवंबर के पहले सप्ताह में सुना जाएगा, सिब्बल ने पहले की तारीख का अनुरोध किया था क्योंकि इसका मुख्य आधार मामले में लंबित याचिकाओं के बैच के साथ कुछ भी नहीं था।

सिब्बल ने कहा, "यह पहले नहीं सुनाया जा सकता है। इसका आधार मामले से कोई लेना-देना नहीं है। यह धन बिल से संबंधित मुद्दे के बारे में है और गोपनीयता के अधिकार के साथ कुछ भी नहीं है।"

हालांकि, पीठ ने कहा कि याचिका नवंबर में सुनाई जाएगी।

सर्वोच्च न्यायालय ने 30 अगस्त को कहा था कि वह नवंबर के पहले सप्ताह में विभिन्न सामाजिक कल्याण योजनाओं के लाभों का लाभ उठाने के लिए अनिवार्य बनाने के लिए सरकार के कदम को चुनौती देने वाली याचिकाओं का बैच सुनेंगे।

सुप्रीम कोर्ट ने फरवरी में यह नोट किया था कि यह रमेश के आधार पर नहीं है "लोकसभा अध्यक्ष के फैसले को आधार कानून में संशोधन करने के बिल को प्रमाणित करने के फैसले को चुनौती देने के लिए" किसी भी तरह से सहमत नहीं है "

केंद्र ने इस याचिका का विरोध करते हुए कहा कि यह मानदंडों को पूरा करता है क्योंकि कल्याणकारी योजनाओं के लिए व्यय को भारत के समेकित निधि से खींचा जाना था।

रमेश ने पहले सर्वोच्च न्यायालय में दावा किया था कि आधार (वित्तीय और अन्य सब्सिडी, लाभ और सेवाएं लक्षित) विधेयक, 2016 को राज्य सभा द्वारा इसकी जांच से बचने के लिए एक धन बिल के रूप में प्रमाणित किया गया था, जिसमें ऐसे कानूनों पर कोई बात नहीं है ।

इस विधेयक पर पिछले वर्ष 11 मार्च को लोकसभा ने चर्चा की और पारित किया।

यह राज्यसभा में 16 मार्च को किया गया था, जहां इसमें कई संशोधन किए गए थे।

बिल को उसी शाम को लोकसभा में लौटा दिया गया, जिसने ऊपरी सदन द्वारा अपनाई गई सभी संशोधनों को खारिज कर दिया और इन परिवर्तनों में से किसी के बिना इसे पारित किया।


New Delhi, Sep 1 The Supreme Court today said it would hear Congress pioneer Jairam Ramesh's supplication testing the Lok Sabha Speaker's decision to certify a bill to revise the Aadhaar law as a money bill in the first week of November.

The issue was specified before a bench headed by Chief Justice Dipak Misra by senior advocate Kapil Sibal, who was speaking to Ramesh and was looking for an early hearing on the request.

At the point when the bench , additionally involving Justices A M Khanwilkar and D Y Chandrachud, said the issue would be heard in the principal seven day stretch of November, Sibal asked for a before date as it had nothing to do with the group of petitions pending in the primary Aadhaar matter.

The Bill was examined and gone by the Lok Sabha on March 11 a year ago.

It was taken up in the Rajya Sabha on March 16, where a few alterations were made to it.
